Brexit Consequences for UK automotive manufactures | Customs4trade

The Commission published a notice for stakeholders concerning the Brexit consequences for manufacturers of motor vehicles and their trailers and of systems, components and separate technical units intended for such vehicles. The notice refers to the application of Directive 2007/46/EC, which requires motor vehicles sold in the EU to be accompanied by a valid certificate of conformity issued by the manufacturer attesting that the vehicles have been manufactured in conformity with the EU type-approval granted by a Member State authority.

The notice highlights the Brexit impact in terms of the identification of economic operators and in terms of the competence of the UK authorities. With regards to the identification of economic operators, from the date UK will leave the EU (March 2019), UK motor vehicles manufacturers will need to appoint a representative established in the EU to represent them before the Member State type-approval authorities. As for the competence, from the withdrawal date, the UK will no longer be considered an EU approval authority and, therefore, will not be entitled to issue an EU type-approval for motor vehicles anymore.


Consequently, as from March 2019, UK manufacturers will not be able to place motor vehicles and their components in the EU market based on the type-approvals issued by the UK authorities. These manufacturers will need to request a type-approval from an EU Member State, through their EU representatives. For the type-approvals issued by the UK before March 2019, the Commission is considering how to ensure continued compliance with EU law.
